Terms of Service, License, and Refund Policy

KoreSync & OS Sync Software

IMPORTANT NOTICE

Homes By Abner Corp. is a marketing and software company and is not a real estate brokerage.

Real estate services, if any, are provided separately by Abner Flores, REALTOR® (CA DRE #02105120) through eXp Realty of California, Inc. (DRE #01878277).

1. Acceptance of Terms

By purchasing, accessing, or using KoreSync or OS Sync, you agree to be bound by these Terms of Service, License, and Refund Policy.

These terms apply to all purchases made through our website, including those processed via WooCommerce and PayPal.

If you do not agree, do not purchase or use the software.

2. Digital Product and Delivery

All products are digital software products and are delivered electronically via:

  • Email
  • Download link
  • Account access

Delivery is considered complete once access has been provided through WooCommerce or email confirmation.

3. Annual Subscription License

KoreSync and OS Sync are sold as annual subscription licenses.

Your purchase grants:

  • Access for one year from purchase date
  • Software updates during the active license period when available

Your license:

  • Is non transferable
  • Does not grant ownership of the software
  • Must be renewed annually to maintain access

We reserve the right to modify features, functionality, or pricing upon renewal.

4. No Refund Policy

Due to the nature of digital products, all sales are final.

No refunds, cancellations, or exchanges will be provided once access has been delivered.

Limited Exceptions

Refunds may only be considered if:

  • Duplicate charge occurred
  • Product was not delivered due to a verified issue on our end
  • Product is completely non functional and cannot be resolved

All refund decisions are made at our sole discretion.

5. PayPal Payments and Disputes

All payments are processed through PayPal.

By completing your purchase, you agree:

  • To contact us at support@hbyacorp.com before initiating any dispute
  • Not to file a chargeback without first attempting resolution

We reserve the right to:

  • Suspend or terminate access upon dispute
  • Revoke your license
  • Submit transaction records, delivery confirmation, and access logs as evidence

6. Required Third Party Subscriptions

KoreSync and OS Sync require active third party subscriptions.

Examples include:

  • BoldTrail CRM for KoreSync
  • Only Social for OS Sync

These services:

  • Are not included in your purchase
  • Require separate payment
  • Are governed by their own terms

We are not responsible for third party platforms such as BoldTrail or OnlySocial.

7. Third Party API and Infrastructure Disclaimer

Our software depends on third party APIs, platforms, and infrastructure.

We are not responsible for:

  • API changes or deprecations
  • Downtime or outages
  • Feature removals or limitations
  • External pricing or access changes

Functionality may change at any time due to factors beyond our control.

8. No Refunds for External Issues

No refunds will be granted due to:

  • Third party service disruptions
  • API changes
  • Subscription issues with external providers

9. Business and Licensing Separation

Homes By Abner Corp. operates as a software and marketing company only.

Abner Flores is a licensed real estate agent (CA DRE #02105120) operating under eXp Realty of California, Inc. (DRE #01878277).

Separation of Roles

  • Homes By Abner Corp. provides software products only
  • Real estate services are provided separately under eXp Realty

No Brokerage Services

KoreSync and OS Sync:

  • Do not provide brokerage services
  • Do not represent buyers or sellers
  • Do not facilitate real estate transactions

No Agency Relationship

Use of this software does not create:

  • A broker client relationship
  • An agent client relationship
  • Any fiduciary duty

10. Software License Restrictions

You may not:

  • Resell, distribute, or sublicense the software
  • Reverse engineer or modify the software
  • Share login or access credentials

Violation may result in immediate termination of access.

11. Technical Support

Support is available via:

support@hbyacorp.com

We will make reasonable efforts to assist with technical issues. Resolution times are not guaranteed.

12. Limitation of Liability

To the fullest extent permitted under California law, we are not liable for:

  • Loss of profits or business
  • Data loss
  • Service interruptions
  • Third party failures or outages

13. Force Majeure

We are not responsible for failure or delay caused by events beyond our control, including:

  • Third party service failures
  • API disruptions
  • Infrastructure outages
  • Cybersecurity incidents
  • Government actions

14. Governing Law

These terms are governed by the laws of the State of California.

All disputes shall be handled within California jurisdiction.

15. Customer Acknowledgment

By purchasing KoreSync or OS Sync, you acknowledge that:

  • This is a digital product with no refunds
  • You are purchasing an annual license
  • Third party subscriptions are required and not included
  • Functionality depends on external services
  • Features may change over time
  • This product is not provided by a real estate brokerage
